The exact scope, specifications, price, and estimated delivery schedule for a project may be described on our website, checkout page, invoice, quotation, order confirmation, or other written communication with the customer.
Orders and Project Agreements
When placing an order, the customer agrees to provide accurate and complete information regarding the requested project.
An order becomes subject to these Terms once payment is submitted or the project is otherwise formally accepted by both parties.
The agreed project scope determines what work is included in the purchase.
Requests that materially exceed or change the original project scope may require:
- Additional fees;
- A revised quotation;
- Additional development time; or
- A separate order.
We will not charge a customer for material additional work without communicating the additional cost.
Pricing and Payments
Prices are displayed or communicated to the customer before payment or project confirmation.
Customers are responsible for reviewing the applicable service description, project scope, price, and any disclosed additional charges before completing payment.
Depending on the project, payment may be required:
- In full before work begins;
- As an initial deposit followed by milestone payments; or
- According to another payment schedule agreed in writing.
All payments must be made using an authorized payment method.
The customer represents that they are authorized to use the payment method submitted for the transaction.
We reserve the right to pause work when an agreed payment becomes overdue.
Payment Processing
Payments may be processed by independent third-party payment service providers.
Payment processing may therefore be subject to additional terms, security checks, fraud-prevention measures, and processing requirements imposed by the applicable payment provider or financial institution.
GetDevotech does not store complete payment card details when payment information is processed directly by an authorized third-party payment processor.
A payment appearing on a bank or card statement does not change the identity of GetDevotech as the provider of the services described in the applicable order, except where a payment provider expressly acts as merchant of record.
Customer Authorization
By submitting payment, the customer confirms that:
- The order information is accurate;
- The customer is authorized to use the selected payment method;
- The customer understands the service being purchased;
- The applicable price has been disclosed before payment; and
- The customer authorizes the applicable charge for the agreed service.
Unauthorized or fraudulent use of payment methods is prohibited.
Project Delivery
Estimated delivery periods may be provided before or after an order is placed.
Unless expressly identified as guaranteed in writing, delivery dates are estimates rather than absolute deadlines.
Delivery may be affected by circumstances including:
- Project complexity;
- Customer-requested modifications;
- Delayed feedback or approval;
- Missing files or content;
- Delayed access to hosting, APIs, servers, or accounts;
- Third-party outages;
- Changes in project scope; or
- Technical circumstances that could not reasonably have been identified before development began.
If a material delay occurs, we will make reasonable efforts to communicate with the customer and provide an updated estimate.
Customer Responsibilities
The customer must provide any information reasonably required to perform the purchased services.
Depending on the project, this may include:
- Website content;
- Images;
- Logos;
- Brand guidelines;
- Hosting credentials;
- Domain access;
- Server credentials;
- API credentials;
- Database information;
- Technical requirements; and
- Timely feedback and approvals.
The customer is responsible for ensuring that they have the legal right to provide and use any content, software, trademarks, images, data, or other materials supplied to GetDevotech.
Revisions
Revision availability depends on the service or project purchased.
Revisions generally cover reasonable modifications to work included within the originally agreed project scope.
A revision does not include an entirely new project, substantial redesign, additional pages, additional functionality, or features that were not included in the original agreement.
Such requests may be quoted separately.
Cancellation and Refund Policy
Because GetDevotech provides customized professional development services involving developer time and project-specific work, refund eligibility depends on the status of the project.
Before Work Begins
If the customer requests cancellation before substantive work has started, the customer may request a full refund, except for any clearly disclosed and non-recoverable third-party costs already incurred specifically for the project.
After Work Has Begun
If development has already started, GetDevotech may provide a partial refund based on the portion of the project that has not yet been completed.
Amounts reasonably attributable to work already performed may be deducted from the refund.
Completed Projects
Once the agreed work has been substantially completed and delivered, payments for the completed work are generally non-refundable.
This does not prevent the customer from reporting legitimate defects, missing agreed functionality, or other failures to provide the services that were purchased.
Failure to Deliver
If GetDevotech is unable to provide a material portion of the purchased service and no reasonable alternative can be agreed upon, the customer may be eligible for a full or partial refund corresponding to the undelivered portion of the service.
Duplicate or Incorrect Charges
If a customer believes they were charged more than once or charged an incorrect amount, they should contact us at webdesignorder1@gmail.com.
Confirmed duplicate or erroneous charges will be corrected or refunded as appropriate.
Refund Method
Approved refunds will normally be returned to the original payment method used for the transaction whenever supported by the applicable payment provider.
The time required for a refund to appear in the customer’s account may depend on the payment provider, card network, or customer’s financial institution.
Nothing in this Refund Policy limits any non-waivable consumer rights available under applicable law.
Payment Disputes and Chargebacks
Customers are encouraged to contact us at webdesignorder1@gmail.com before initiating a payment dispute so that we have an opportunity to investigate and resolve legitimate billing or service issues.
We will cooperate with payment processors, card networks, financial institutions, and other authorized parties when responding to payment disputes.
We may provide relevant transaction and project records, including invoices, order details, communications, delivery records, approvals, and other appropriate evidence relating to the disputed transaction.
Nothing in these Terms restricts a customer’s lawful right to dispute an unauthorized or otherwise disputable transaction through their payment provider.
Project Acceptance
Customers should inspect delivered work within a reasonable period and report any material issue relating to the agreed project scope.
A project may be considered accepted when the customer:
- Explicitly approves the completed project;
- Deploys or publishes the delivered project;
- Begins commercially using the delivered project; or
- Otherwise confirms that the agreed work has been completed.
Acceptance does not eliminate any rights that cannot legally be waived.
Intellectual Property
Unless otherwise stated in a separate agreement, ownership of custom deliverables created specifically for the customer transfers to the customer after all amounts due for the project have been paid in full.
GetDevotech retains ownership of its pre-existing intellectual property and general development resources, including reusable:
- Code;
- Libraries;
- Frameworks;
- Development methods;
- Templates;
- Internal tools;
- Technical processes; and
- Know-how.
Third-party components remain subject to their respective licenses.
Third-Party Products and Services
A project may depend on third-party services including:
- Hosting providers;
- Domain registrars;
- Cloud infrastructure;
- APIs;
- Payment processors;
- Content management systems;
- Plugins;
- Frameworks;
- Software libraries; and
- External platforms.
Unless specifically included in the project price, the customer is responsible for third-party fees.
We cannot guarantee the continued operation, pricing, availability, compatibility, or policies of independent third parties.
Security and Maintenance
GetDevotech uses reasonable development practices appropriate to the services being provided.
However, no website, application, server, database, or online system can be guaranteed to be completely secure or continuously available.
After project delivery, the customer is responsible for ongoing security, hosting, software updates, backups, credentials, and maintenance unless ongoing maintenance services have been purchased from GetDevotech.
Prohibited Uses and Projects
GetDevotech does not knowingly provide services intended to facilitate unlawful or prohibited activity.
We may reject, suspend, or terminate projects involving activities including:
- Fraud or deceptive activity;
- Malware or malicious software;
- Phishing;
- Unauthorized access to systems or accounts;
- Stolen financial information;
- Counterfeit or unauthorized goods;
- Illegal drugs;
- Illegal gambling;
- Unlawful weapons transactions;
- Intellectual property infringement;
- Hate-based illegal activity;
- Pyramid or Ponzi schemes; or
- Other activity prohibited by applicable law or our payment providers.
We may also refuse a project when continuing it could expose GetDevotech or its financial partners to material legal, compliance, fraud, or security risks.
Confidentiality
We will take reasonable measures to protect confidential project information received from customers.
Confidential information may include private source code, credentials, unpublished business information, technical documentation, or other information reasonably understood to be confidential.
This obligation does not apply to information that:
- Is publicly available through no violation of these Terms;
- Was lawfully known before disclosure;
- Was independently developed;
- Was lawfully obtained from another source; or
- Must be disclosed under applicable law or legal process.
Portfolio Use
Unless otherwise agreed in writing or prohibited by confidentiality obligations, GetDevotech may identify publicly launched projects as examples of work performed by the company.
We will not intentionally publish confidential credentials, private customer data, private databases, or other non-public confidential information as part of a portfolio.
No Guarantee of Commercial Results
Unless specifically guaranteed in a separate written agreement, GetDevotech does not guarantee that a website or software project will produce any particular:
- Revenue;
- Sales;
- Search engine ranking;
- Traffic level;
- Conversion rate;
- Customer acquisition result;
- Advertising performance;
- Business profit; or
- Third-party platform approval.
Our obligation is to provide the development services included in the agreed scope, rather than guarantee a customer’s commercial outcome.
Limitation of Liability
To the maximum extent permitted by applicable law, GetDevotech will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of our services.
This may include loss of profits, revenue, business opportunities, or data.
To the maximum extent permitted by law, GetDevotech’s aggregate liability relating to a specific project will not exceed the amount actually paid to GetDevotech for the portion of the services giving rise to the claim.
These limitations do not apply where liability cannot legally be excluded or limited.
Indemnification
To the extent permitted by applicable law, the customer agrees to indemnify and hold harmless getdevotech LLC from third-party claims resulting from materials, instructions, content, or data supplied by the customer that infringe another party’s rights or violate applicable law.
Suspension or Termination
GetDevotech may suspend or terminate a project where:
- Required payments remain unpaid;
- The customer materially violates these Terms;
- Fraudulent activity is reasonably suspected;
- The requested work is unlawful;
- Continuing the project creates a material security or compliance risk; or
- The customer materially abuses our services or systems.
Termination does not eliminate payment obligations for work legitimately completed before termination.
Electronic Communications
The customer agrees that project-related communications, invoices, notices, approvals, and other records may be provided electronically.
Electronic communications and confirmations may be retained as business records where permitted by applicable law.
Governing Law
These Terms and any dispute relating to the services provided by getdevotech LLC will be governed by the laws of the State of Wyoming, United States of America, without regard to its conflict-of-law principles, except where applicable mandatory law provides otherwise.
Changes to These Terms
We may update these Terms from time to time to reflect changes to our services, legal requirements, payment methods, or business practices.
The current version and its effective date will be published on our website.
Changes will not retroactively alter material terms of a completed transaction unless required by law or agreed with the customer.
